admitted to throwing punch

Kevin Joseph Toman (32), Albert Avenue, Lurgan, was given 150 hours community service for disorderly behaviour on June 16 last year.

The court heard that around 10pm on CCTV the defendant was seen getting into a car and it took him to the scene of a fight.

Toman attempted to break up the fight and is seen pushing people away but he appeared to punch one person in the head.

Police arrive and Toman was cautioned. When interviewed he said he was told his cousin was being attacked.

He claimed he saw his cousin on the ground being assaulted and he tried to pull him away. He hit out in self defence.

The case had been adjourned from a previous court so that a pre-sentence report could be obtained.

Mr Conor Downey, representing the defendant, said CCTV showed quite clearly Toman was not acting in an aggressive manner and was trying to separate people.

He added that Toman accepted he did throw one punch but that was the height of it.

Mr Downey said his client’s main focus was to extract his cousin from the other people who were fighting. He added that the main difficulty facing Toman was that he had a suspended sentence hanging over him.

District Judge, Mr Peter King, said that having heard what was said by the prosecution and Mr Downey he would not interfere with the suspended sentence.
