Punishment beating victim is denied bail

Gerald Patrick Lavy, of Ballymagowan Avenue, is accused of possessing drugs with intent to supply between February and March, last year.

The Crown Court heard the 30-year-old was re-arrested last month on a charge of possession of drugs and was remanded in custody.

Opposing bail, an investigating officer told the court police fear Lavy will commit further offences.

She said that he has 11 previous convictions for drug offences.

Defence counsel Sean Doherty said there were ongoing medical issues as a result of a serious assault on Lavy.

He said his client was currently walking with the assistance of crutches and was being treated as an outpatient up until he was arrested.

Mr Doherty said he feared the 30-year-old wasn’t receiving the necessary care that he requires in all the circumstances while he was in Maghaberry.

Judge Philip Babington said there is no doubt Lavy “received a very severe beating by those who try to police the community”.

The judge refused bail but urged the prison authorities to give him careful consideration. “This court is concerned that he should be treated properly,” he said.

Lavy was remanded in custody and will appear in court again on June 18.
