Waste breaches

Mr Frank McHenry (56) of Torr Road, Ballycastle, was fined a total of £918 at Coleraine Magistrates’ Court for breaches of waste management legislation.

The court was told that in June 2011, officers from the Northern Ireland Environment Agency carried out a site inspection on lands off the Glenshesk Road, Ballycastle, where they found an estimated 160 tonnes of controlled waste including tarmac, concrete, kerbstone, plastic, metal, polystyrene and electrical cable.

Mr McHenry who owned the land at Glenshesk Road, pleaded guilty on 4 September to two charges of depositing controlled waste without there being in place an exemption or licence.

He was fined £500 and £418 respectively plus court costs of £82 and an offenders levy of £15.

Car dealer fined

A Ballycastle Car Trader who sold a clocked car has been fined a total of £1,000 and conditionally discharged for two years at Coleraine Magistrates’ Court.

In a case brought by the Trading Standards Service of the Department of Enterprise, Trade and Investment, Oliver McHenry pleaded guilty to seven charges under the Consumer Protection from Unfair Trading Regulations 2008.

The charges related to the sale of one vehicle on which the mileage had been reduced and the advertisement of several others in which Mr McHenry concealed the fact that he was a car trader. In January 2013, a consumer bought a Mercedes car from Mr McHenry with 90,800 miles on the clock only later to discover that the car had previously travelled in excess of 170,000 miles. McHenry also failed to disclose to the consumer that he was a car trader.

Moira Todd of the Trading Standards Service said: “The mileage that a used car has travelled significantly affects its value and saleability. Car traders have a legal responsibility to ensure that the mileage on a car they are offering for sale is accurate. Anyone who is in the practice of selling cars for profit can be considered to be a car trader. They do not have to have trade premises to be a car trader. However they are required to disclose or not to conceal the fact that they are in business. A trade who poses as a private seller often does so in an attempt to avoid any comeback if something goes wrong with whatever they’ve sold”.

Anyone who believes they have been sold a clocked car should contact Consumerline on 0300 123 6262.
